The proposed micro-credential study-unit titled ""Introduction to Maltese Law"" will provide a comprehensive introduction to both the most basic and the most crucial aspects of Maltese law. This micro-credential study-unit is designed to equip learners with foundational knowledge in key areas, including constitutional law, criminal law, corporate law, employment law, family law, and contract law.

Study-unit Aims

By covering the essential areas mentioned above, this micro-credential study-unit will enable participants to develop a solid understanding of the legal framework in Malta, addressing the laws that govern both individual rights and societal operations. The focus on these critical legal domains will ensure that learners are well-prepared to navigate Malta's legal landscape, whether for professional development, business operations, or personal enrichment.


Learning Outcomes: Knowledge and Understanding

By the end of the study-unit the student will be able to:

Upon successful completion of this study-unit, participants will be able to:

  • Explain the fundamental principles of Contract Law, including contract formation, enforcement, and termination, and analyze the rights and obligations of contracting parties;
  • Identify and evaluate the main principles of Family Law in Malta, including marriage, divorce, custody, and child protection, and apply these principles to the resolution of family-related disputes within the Maltese legal system;
  • Describe and assess the structure and core functions of Maltese Constitutional Law, with particular reference to the protection of human rights and the roles of governmental institutions;
  • Differentiate between various types of criminal offences and outline the key stages of the criminal justice process in Malta;
  • Interpret and apply the provisions of Company Law and Corporate Insolvency Law by analyzing the legal framework for company formation and management in Malta, and evaluate mechanisms of corporate insolvency and debt restructuring.

Learning Outcomes: Skills

By the end of the study-unit the student will be able to:

Participants will develop the following skills:

  • Learners will be able to apply the principles of Contract Law to draft, interpret, and assess contracts in both personal and professional contexts, ensuring legal validity and fairness;
  • They will be equipped to analyze and advise on legal issues related to Family Law, such as marriage, divorce, and custody, helping individuals navigate family disputes within the Maltese legal framework;
  • Learners will develop critical thinking skills to evaluate Constitutional Law matters, including human rights cases and government actions, in relation to Maltese constitutional principles;
  • They will gain the ability to identify and address legal issues in Company Law and Criminal Law, supporting businesses in regulatory compliance and analyzing criminal cases in light of Maltese criminal laws.
